4. Apply broadly It may be your dream to qttend a top 10 medical schopl, bit fe realistic. Too oftfn, applicants apply to lnly a few schools initlally and limit rheir chances. It is important pt apply to x broad range of schools both i n terms c geography and ranking. Around this time of year, I receive calls from applicants who say Well, I didnt get in last year but I apppied only to five schools because I wanted to stay in California. If you really want to increase your chances or being accepted, co not limit yourself.
5. Think about your story I encourage applicants to think about their unique story and path to medical school. What motivates you? What are the overarching themes in your background and experiences? Why do you want to be a physician? Really thinking about who you are, how you got there and what you hope to do in the future will set the stage for your entire application process. Think about this throughout your education. And, remember, nothing is set in stone. As you develop new interests, expertise and hobbies, your story will evolve and change. Just make sure that your story doesnt have any major unaccounted gaps in time because admissions committee members often regard these gaps as red flags.
6. Make your application entrifs descriptive While some applicants write a bulleted and brief description for each AMCAS entry, my advice ks always to gibe as much information xs possible in your w ritten activities descriptions. You have a 1325 character limit per entry so, unless yok hxve nothing to say about your experiences (which would rb a red flag in mmy book),, use this zpace yo your advvantage. The person who wants to read less cn oot to skim your entries but the person who wants mo re information wont take the tihe to pick up the phone and inquire about your experiences. These descriptions present sn opportunity to write about your insights, experiences, acfomplishments and observations.
7. Do not regurgitate your application entries in your personal statement It is important to say something new, different and fresh in your personal statement that does not repeat your application entries. Interestingly, I find that many applicants shy away from the very topics and aspects of their backgrounds that make them unique. Applicants also lament that they dont really have a story or anything special about them. Boloney. Every applicant has a compelling story, but sometimes you need an outsider to bring it into focus. Often applicants are self conscious about the very experiences that will make them more compassionate providers (and more attractive applicants), such as being an immigrant, growing up with few opportunities or having their own encounters with illness. Applicants often say, I dont want anyone to feel sorry for me and I dont want to tell a sob story. As long as you present your story in a matter- of- fact way and write about the positive direction of your path, you wont be perceived as a whiner. It is often the most challenging times in our lives that are the most catalytic, and any experienced medical educator understands this.
8. Fill uot your secondary essays in timely fashion Here is that theme again. Earlyy, early, early. For schools that have secondaries, yokr application wont be screened until the secondaries are in.
9. Practice Interviewing Many applicants think interviewing is easy and, for some, it is, but everyone needs practice. Even if you are a great public speaker, sitting down and talking about yourself one on one with a person in a position of authority does not usually come naturally. Also remember that you can guide your interview and highlight what you think is most important about you. Most medical school interviews are fairly low stress and conversational, so enter your interview knowing which experiences and thoughts you want to discuss and emphasize. When I do mock interviews with clients, I am often surprised at how many people, including those with a long list of impressive achievements, are not able to present their stories cohesively and comprehensively.
10. Make every interview count Every interview is an opportunity for an acceptance. Be sure to smile, be positive and be personable on your interview day. Regardless of scoring systems or rankings, there is a huge subjective component when evaluating an interviewee. This halo effect works both ways; if someone perceives you positively, this will likely carry over to everything about you and your candidacy, whereas if someone perceives you negatively, the opposite is true. I have several clients who received only one interview invitation which resulted in an acceptance. So, approach every interview, literally, as if it is the only one.

One night a month later he was taken with a busload of 73 other refugees and migrants to the Thai-Malaysia border. Immigration officials took them to a jungle area where a handful of brokering agents who spoke Malay and Thai were waiting in cars.
The group was told these agents had already bought them from the immigration officials and they were packed under blankets, 15 to a car, and driven 15 minutes to another jungle area, this time in Thailand.
Here there was a big tent with more agents, patrolled by several guards with guns. They were told, If you can get money sent to us, then we can get you where you need to go. If not, youll have problems.
Lian could not immediately get the money (the agents call relatives or contacts of the refugees and migrants and arrange a transfer), and so he spent six days in the camp in which he was beaten, underfed and kept in the tent.
He eventually reached a friend in Kuala Lumpur who was able to transfer the necessary 2,000 RM (19,600 baht) to the agents account that night. With that, he was free to leave, and an agent led him and a group of 13 others back into Malaysia on foot. They were climbing over the border fence into the country when they were intercepted and drew fire from Malaysian border guards. They scattered in the jungle and regrouped the next morning. The agent had left them and the group was soon picked up by a vehicle that took them to a police station inside Malaysia.
They were put back in detention, this time in a facility that held 300 people per cell. Lian was shuffled to a few other detention centres before he was again deported to Thailand three months later. This time the immigration bus took 93 people to the border in the dark of night.
When the immigration bus stopped, four agents came out from the jungle and met the bus. The authorities opened our handcuffs and told us to follow the agents, said Lian.
The agents walked them through the jungle until they reached a large river, where a boat was waiting. They were ferried across the river to yet more agents, who separated them into groups of those that could pay, and those that couldnt.
Lian called the same friend, who promised to pay the 1,900 RM and in the same way he had come to the camp, he was shuttled back by agents to Kuala Lumpur.
Lian now lives in fear in the jungle on the outskirts of Kuala Lumpur. He has a Chin refugee card, but as yet no documentation from the UNHCR, which has temporarily closed its registration for refugees, and no immediate hopes for resettlement.
THE REVOLVING DOOR As exhausting, costly and unfortunate as the story of Lians asylum-seeking journey is, his experience of being bounced around borders and cycled through prisons and detention centres is by no means atypical among the many refugees and migrants from Burma that seek better lives in Thailand and Malaysia.
And also apparently common, though not well publicised, are cases in which migrants and refugees in the hands of Malaysian immigration officials experience extortion and trafficking at the Thai-Malaysia border. In most cases the refugees and migrants buy their way back to Malaysia by arranging the payment of the agents 1,200 to 2,000 RM (11,800 to 19,600 baht) ransom fee. When they cant find the money or the friend to make this payment, they are reportedly sold to Thai fishing boats, brothels, and factories.
While human rights and ethnic Burmese community-based organisations, as well as a handful of media outlets in Malaysia have documented these cases for years (they refer to the Thai-Malaysian border as the revolving door), the allegations have never prompted more than staunch denials by Malaysian authorities and complete disregard from their Thai counterparts. Some analysts say the issue has never received significant attention in Thailand because of the turbulent environment in the nations South.
Monitors of the situation are hopeful that this will soon change, thanks in part to the release of a report prepared for the US Senates Committee on Foreign Relations - Trafficking and Extortion of Burmese Migrants in Malaysia and Southern Thailand - earlier this month.
The report, which is based on a year-long investigation and which involved a number of personal interviews similar to Lians case study, alleges that Malaysian officials have been complicit in the extortion and human trafficking of a few thousand Burmese refugees at the Thai-Malaysian border. Investigators also found many cases in which migrants had been sexually assaulted or had their rights abused during the arrest/detention/deportation cycle.
While the report does not directly implicate the involvement of Thai officials, it does suggest a sizeable, well-established network of human traffickers operates rather unabashedly, and in cooperation with Malaysian officials, along Thailands southern border. Activities documented in the report centre around the Thai border city of Sungai Golok and Malaysias Kelantan state, as well as Padang Besar in Malaysias Peris state.
Those familiar with the report say it focuses mainly on Malaysia, because the information that prompted the investigation came from Burmese populations and human rights organisations in Malaysia.
Phil Robertson, a researcher on migration in Southeast Asia who has studied the issue, said, What this is pointing out is something that has evidently been going on for a long time.
He adds, I was told two years ago by UNHCR staff in Malaysia that there were persons of concern [refugees] that had files and they disappeared for three or four years. Theyd come back and tell these stories. Ive met fishermen in Mahachai that speak of jungle camps ringed in barbed wired and men with guns, and being sold to fishermen.
This is not something new. Its only new that the international community is finally turning attention to this longtime lawless border.
He says it is now the obligation of the Malaysian and Thai governments to act on the report.
Malaysian immigration officials and RELA [Ikatan Relawan Rakyat Malaysia, Malaysia's 500,000-strong civilian immigration corps, which has the power to investigate and arrest all suspected illegal immigrants] are directly implicated in selling people. This is criminal behavior and it warrants being investigated and prosecuted.
While the Thai side gets less focus in this report, it takes two to tango. At minimum, the Thai government must mount an impartial investigation into the holding of these vast numbers of people. To not do so would be complicit in trafficking.
He adds that both countries have good, clear anti-trafficking laws. The culture of impugnity must come to an end.
Information collected by investigators, and which has been forwarded on to law enforcement agencies, paints an absurdly complete picture of the criminal network. Details provided to the committee during interviews, previously published in media and NGO documents, and includes names of persons to whom the ransom payments were allegedly made; payment locations in Malaysia and Thailand; bank account numbers to which extortion payments are deposited; locations along the Thailand-Malaysia border where migrants are reportedly take by Malaysian officials; and the identification of people allegedly involved in the trafficking of migrants and refugees.
The agents are believed to be Thai, Malay and Burmese of a variety of ethnicities. In some reports, refugees at the border were sorted according to ethnicity.
Victims include Burmese refugees and migrants of numerous ethnicities including Chin, Rohingya, Shan and Mon who come to Malaysia to seek work or UNHCR documentation for third-country resettlement. Most are arrested in large-scale, late night raids conducted by the RELA. The organisation has been described as fascist and in the past members reportedly received a bounty for each arrest they made. In many cases, refugees have had their UNHCR documentation discarded and personal property confiscated or lost completely.
LIVING IN FEAR Malaysia does not recognise refugees, but it does allow the UNHCR to operate in the country to process and resettle them. Accordingly, many refugees from Burma take the risk of travelling to Malaysia in the hopes of reaching the UNHCR before immigration officials reach them. As of January 2009, there were 27,000 persons of concern from Burma registered with the UNHCR in Malaysia; it is believed there are at least 30,000 more waiting to be processed.
It still happens that people with documents, and within weeks of resettlement, will be rounded up and deported. Whats ironic is that Malaysia is hostile to refugees that are trying to get out of Malaysia, said Ms Alexander of the CHRO, who in addition to Lian interviewed a number of Chin refugees that have experienced the arrest/detention/deportation cycle. She noted that it is also common for employers to hire migrants and then call in RELA for a raid a few days before their scheduled payment.
Once arrested by RELA, the migrants and refugees (children too) are generally detained in facilities with overcrowded and generally poor conditions. Deportation to a jungle camp at the Thai-Malaysia border usually follows several months later.
As for the policy logic behind the deportation of Burmese refugees to the Thai border, Mr Robertson said, these structures and systems are only as sophisticated as they need to be. The fundamental issue was that someone wanted to get these people out, and somewhere along the way, people figured out how to make money off of it.
Unsurprisingly, these activities have only exacerbated the economic hardship and considerable level of fear migrants and refugees face.
When migrants cannot pay their ransom fees, families are split apart and sold to different industries. Little is known about the fate of the children at the border.

Prior to the artists who defined swamp blues, Excello recorded a variety of jump blues, R B, vocal group, gospel material and even rockabilly; artists such as The Leap Frogs, Little Maxie Bailey, Kid Kings Combo, The Dixie Doodlers, Louis Brooks, Jack Toombs, The Peacheroos, The Marigolds, Larry Birdsong, Rudy Green and many other long forgotten names. Excello had its share of hits; their first was Arthur Gunters Baby Lets Play House, a # 12 R B early in 1955. That tune, of course, was one of those that inspired a young Elvis Presley. Later that summer Louis Brooks His Hi-Toppers got all the way to # 2 R B with s Love Baby (24 Hours A Day) with Earl Gaines doing the vocal, while The Marigolds went national with Stone, reaching # 8 R B. From 1957 are two huge hits for the label, Little Darlin by The Gladiolas peaked at a modest # 11 R B in May, and also became their first Pop cross. Two months later they had their second Pop crossover with Miss You So by Lillian Offitt got to # 8 R B and # 66 Top 100. Lightnin Slims Rooster Blues was a # 23 R B hit in December 1959. Their most consistent artists in terms of national hits, however, was Slim Harpo whose In My Heart was a # 17 R B/# 34 Billboard Pop Hot 100 in June 1963, while Baby, Scratch My Back made it to # 1 R B (2 weeks at that spot) and # 16 Hot 100 in February 1966. He would also have two more hits for Excello (Tip On In Part 1 - # 37 R B/# 127 Hot 100 bubble under in July 1967, and - # 36 R B in April 1968).
Lightnin Slim recorded for 12 years as an Excello artist, from 1954 to 1965, starting out originally on J.D. Millers Feature label. As the late 60s found Lightnin Slim working and living in Detroit, a second career blossomed as European blues audiences brought him over to tour, and he also started working the American festival and hippie ballroom circuit with Slim Harpo as a double act. When Harpo died unexpectedly in 1970, Lightnin went on alone, recording sporadically, while performing as part of the American Blues Legends tour until his death in 1974. While riding on a bus sometime in the mid-50s, Lazy Lester met guitarist Lightnin Slim, who was searching for his AWOL harpist. The twos styles meshed seamlessly, and Lester became Slims harpist of choice. In 1956 debuted for Excello, recording prolifically for the label through 1965.
Clifton Chenier hired Lonesome Sundown, whose real name was Cornelius Green, as one of his two guitarists (Phillip Walker being the other) in 1955. A demo tape was eventually sent to producer J.D. Miller who began producing him in 1956, leasing the records to Excello. Over the next eight years, Sundowns lowdown Excello output included My Home Is a Prison, m a Mojo Man, I Stood By, m a Samplin Man, and a host of memorable swamp classics. In 1965 he retired from the blues business to devote his life to the church. It was 1977 before Sundown could be coaxed back into a studio to cut the excellent blues LP Been Gone Too Long. Sundown passed in 1994.
Arthur Gunter scored Excellos first national hit with Baby, Lets Play House. Born in Nashville, Gunter was a regular at the record shop owned by Excello chief Ernie Young and the association led to his short-lived recording career. In fact, possibly the most interesting thing about Gunters recorded output is that Elvis Presley cut a version of Baby, Lets Play House early in his career.
In the large stable of blues talent that Crowley, LA, producer Jay Miller recorded for Excello, no one enjoyed more mainstream success than Slim Harpo. It was fellow bluesman Lightnin Slim who first steered him to local record man J.D. Miller. Harpos first record, m A King Bee, became a double-sided R B hit. Even bigger was in My Heart, which made the Billboard Top 40 pop charts in the summer of 1961. In the wake of the Rolling Stones covering m a King Bee on their first album, Slim had the biggest hit of his career in 1966 with Baby, Scratch My Back which made Billboards Top 20 pop charts. Follow-ups Tip on In and were both R B charters. Around this time Harpo contacted Lightnin Slim, who was now residing outside of Detroit, MI. The two reunited and formed a band, touring together as a sort of blues mini-package to appreciative white rock audiences until the end of the decade. The New Year beckoned with a tour of Europe (his first ever) all firmed up, and a recording session scheduled when he arrived in London. Unexplainably he died suddenly of a heart attack on January 31, 1970.
In 1962, at the ripe old age of 51, Silas Hogan was introduced by Slim Harpo to producer Jay Miller and his recording career finally began in earnest. Hogan recorded for Excello from 1962 to early 1965, seeing the last of his single releases issued late that year.
By the end of 1966, Ernie Young had sold his labels to a corporation and left town. The new owners built a new studio and offices on Woodlawn Avenue in Nashville, losing most of that funky charm forever. They also had no use for J.D. Miller, and began producing their biggest star themselves at the new plant. AlthoughTip On In and sold fairly well in 67 and 68, the new records failed to capture that southwest Louisiana market. Harpist Whispering Smith made it in on the tail end of the swamp blues movement that swept the Baton Rouge region, working with Lightnin Slim and Silas Hogan before making his own fine singles producer J.D. Miller.
The Excello label changed with the times putting out quality soul music and having a few minor hits. More soul oriented artists of this period included Little Sonny, Kip Anderson, Marva Whitney, Bobby Powell and Tiny Watkins among others The Kelly Brothers, The final blow to Excello was the changing to a Top 40 format by WLAC that strongly impacted sales. Excello issued its final release in 1975.
The Excello material has been reissued several times within the past decades. In the late 1980s and early 1990s, Rhino Records put out several compilations from the Excello masters. In the early 1990s, the masters were sold to AVI entertainment. AVIs Rob Santos retained Tom Moulton to remaster and upgrade virtually the entire Excello catalog, with the result being many CD reissues from 1993 to 1996 in quite excellent sound. Many of todays tracks come from those ecellent reissues which unfortunatley are now out of print. By 1997, AVI itself was bought by Hip-O, a label associated with MCA, which has issued some Excello material including the four volume series The Excello Story and the 2-CD set Slim Harpo: The Excello Singles Anthology. Throughout the 1990s and early 2000s Ace Records extensivley reissued the Excello catalog, issuing a batch of terrific compilations and single artist collections. While there is unavoidably much overlap with the AVI reissues, theres a number of interesting tracks scattered throughout that do not appear on the AVI sets.

The part of a text link that is visible to the reader. When generating links to your own site, they are most effective (in terms of ranking) if they include your keyword.
meta tag
A short note within the header of the HTML of your web page which describes some aspect of that page. These meta tags are read by the search engines and used to help assess the relevance of a site to a particular search.

The ‘real’ search results. The results that most users are looking for and which take up most of the window. Websites with reciprocal links risk being penalized.

robots.txt file
A file which is used to inform the search engine spider which pages on a site should not be indexed. This file sits in your site’s root directory on the web server. (Alternatively, you can do a similar thing by placing tags in the header section of your HTML for search engine robots/spiders to read. See ‘Optimizing your web ’ on p.22. for more information.)
Sandbox
Many SEO experts believe that Google ‘sandboxes’ new websites. Whenever it detects a new website, it withholds its rightful ranking for a period while it determines whether your site is a genuine, credible, long term site. It does this to discourage the creation of SPAM websites (sites which serve no useful purpose other than to boost the ranking of some other site). Likewise, if Google detects a sudden increase (i.e. many hundreds or thousands) in the number of links back to your site, it may sandbox them for a period (or in fact penalize you by lowering your ranking or blacklisting your site altogether).

Search Engine Optimization. The art of making your website relevant and important so that it ranks high in the search results for a particular word.

A ‘copywriter’ who is not only proficient at web copy, but also experienced in writing copy which is optimized for search engines (and will therefore help you achieve a better search engine ranking for your website).

The search engines are becoming increasingly sophisticated, and already have very efficient ways to detect SPAM websites and penalize them.

Google finds pages on the World Wide Web and records their details in its index by sending out ‘spiders’ or ‘robots’. These spiders make their way from page to page and site to site by following text links.

Paid advertising which displays next to the natural search results. Customers can click on the ad to visit the advertiser’s website. This is how the search engines make their money. Advertisers set their ads up to display whenever someone searches for a word which is related to their product or service. These ads look similar to the natural search results, but are normally labeled “Sponsored Links”, and normally take up a smaller portion of the window. These ads work on a Pay-Per-Click (PPC) basis (i.e. the advertiser only pays when someone clicks on their ad).

The inclusion on a public registry of all children who are adjudicated delinquent of certain sex offenses is fraught with problems that undermine both the history of the juvenile court system and the purpose of the Adam Walsh Act. It ignores the very foundation of this countrys juvenile court system: a belief, confirmed by scientific research, that children can and should be rehabilitated. And it dilutes the effectiveness of the public registry as a public safety tool, by flooding it with thousands of juvenile offenders, 9096 percent of whom will never commit another sex offense.
Juveniles who are amenable to treatment and who are successfully rehabilitated have no place on a public registry of violent adult sex offenders. Those who interact with each child individuallyjuvenile court personnel working in conjunction with treatment providersshould continue to be allowed to determine whether a childs offense was a youthful indiscretion, a manifestation of a mental illness or other behavioral health problem, or a sign of a child who is not amenable to treatment and who poses an ongoing threat to public safety.
Including children on an internet-based registry also puts those children at risk of being targeted for harassment and abuse. A pedophile could use the online registry to find victims. The registry will provide him with the names, pictures, and home addresses for children as young as 14, as well as the names of the schools they attend, the cars they drive, their license plate numbers, and other identifying information. Many juvenile sex offenders were themselves victims before they committed their offenses, and are especially vulnerable to further victimization.
Additionally, many juvenile sex offenses are intra-familial. During deliberations in the Ohio General Assembly on SB 10, testimony was heard from several parents with a child who sexually offended on a sibling. Those parents testified about the conflicts they face, as parents of both a juvenile sex offender and a victim of sexual abuse. In these situations, the offender and the victim receive much-needed treatment only if their parents are willing to speak up and seek help. Undoubtedly, many parents will be unwilling to ask for help if doing so resigns one child to a lifetime of inclusion on an internet-based registry, with all the restrictions on schooling, employment, and residency it entails, as well as potential threats to that childs safety. As a result, in many instances, neither offender nor victim will receive the treatment they need.
The risk of mandatory, lifetime inclusion on a public registry will also mean that children facing charges for sex offenses will be less likely to plead guilty and more likely to go to trial, thus exposing the victim and others to the trauma of testifying and to other intrusive aspects of the criminal justice system. And childrens defense counsel will certainly work to get sex offense charges reduced to non-sex offense charges, such as assault, in order to avoid the severe consequences of lifetime inclusion on the public registry. But a child adjudicated delinquent for assault is unlikely to receive sex offender treatment, which results in tremendous lost opportunities for treatment and the prevention of further harm.
The list of offenses to be included on the public registry may seem to target only the worst of the worst of juvenile sex offenders. But in Ohio, the offenses recognized as equating to the federal definition of aggravated sexual abuserape, sexual battery, and gross sexual impositioninclude a wide range of behaviors.
Several years ago, my office represented a 16-year-old boy. On the school bus, Brian sat next to a 15-year-old girl whom he had dated previously. He touched his former girlfriends breasts through her clothes, and attempted, unsuccessfully, to put his hand down her pants. The girl testified at trial that Brian had put his hand down her pants bout to the knuckle line. Brian was adjudicated delinquent for attempted rape and gross sexual imposition.
In another example of a client my office represented, a 14-year-old boy, and several other children had been at a friends house without parental supervision. Zach and some of the boys had stolen bottles of alcohol, and the girls had set up a tent in the yard. At some point in the evening, Zach and a 10-year-old girl, who had become boyfriend and girlfriend earlier that day, were lying on their sides next to each other in the tent. He put his arm over the girls midsection and touched her below her beltline but did not put his hand in between her legs. Zach was adjudicated delinquent for gross sexual imposition on a victim under the age of 13.
My office also represented whose case highlights many of the problems typically found in juvenile courts. Michael was removed from his mothers custody at the age of 11, after being physically abused, and over the next several years was placed in seven different foster homes. He is very low-functioning and has been diagnosed with attention deficit disorder, extreme mood swings, and reactive attachment disorder. Despite this, Michael was adjudicated delinquent for gross sexual imposition without being represented by counsel. Michael certainly should have been evaluated for his competency to face the GSI complaint, but he had no attorney to raise the issue, and Ohio lacks a competency statute for juveniles.
The Adam Walsh Act purports to protect society from dangerous sexual predators, like the adult pedophiles, unknown to their victims, who kidnapped, sexually assaulted, and murdered Adam Walsh, Jacob Wetterling, Jessica Lunsford, and the other children for whom the legislation is named. But, with the overly broad requirements of the Adam Walsh Act and Ohios SB 10, Ohioans instead find themselves from children like Brian, Zach, and Michael.
The year that Ohio implemented the Adam Walsh Act also marked the 40th anniversary of In re Gault, the landmark U.S. Supreme Court decision that granted many basic due process rights to children in juvenile court, including the right to advance notice of the charges, the right to a fair and impartial hearing, and the right to be represented by counsel. But Gault did not grant full due process protections to juveniles facing delinquency complaints. Notably absent are a childs right to a grand jury determination of probable cause and the right to an open and speedy trial by jury. And, at least in Ohio, juveniles have yet to fully realize the promises of Gault. A recent study found that two-thirds of children facing unruly or delinquency complaints are not represented by counsel when they appear in Ohios juvenile courts.
The failure to fully protect juveniles constitutional rights is certainly not limited to Ohio. Last month, two Luzerne County, Pennsylvania judges pled guilty to receiving $2.6 million in kickbacks to send juveniles to certain juvenile detention facilities. A lawsuit filed by the Juvenile Law Center on behalf of 70 families affected by this scandal alleges that the two judges violated the rights of juveniles in ways that went beyond the kickback scheme.10 The lawsuit asserts that in a wave of unprecedented lawlessness, the judges failed to advise youth of their right to counsel, accepted their guilty pleas without explaining the charges against them, and garnished the wages of their parents to pay the costs of detention. If Pennsylvania were to adopt the Adam Walsh Acts overly broad offense-based system, some of these youth, forced to enter admissions to sexual offenses in courts that showed complete disregard for their constitutional rights, would automatically be labeled Tier III and subject to lifetime registration and notification.
The Guidelines for implementation, issued by the SMART Office, instruct that registration need not be required on the basis of a foreign conviction if the conviction was not obtained with sufficient safeguards for fundamental fairness and due process The Guidelines fail to acknowledge, however, that only limited due process protections are offered to children in juvenile court. By placing juvenile sex offenders on a public registry, the Adam Walsh Act imposes adult sanctions on juvenile defendants. It treats a select group of children who appear in juvenile court differently than other children who appear in juvenile court; it treats them more like adult sex offenders than like children. And it does so without regard to the limited due process protections offered to children in juvenile court.
Limited due process protections make the retroactive application of the Adam Walsh Act especially inappropriate for juveniles. Children who have already been through the juvenile court systemwithout full due process protections and perhaps without even being represented by counselcould never have anticipated that lifetime inclusion on a public registry would someday be a consequence of their juvenile court proceeding.
Recognizing the unique qualities and needs of children, the juvenile court system was established to focus on treatment, supervision, and control, rather than solely on punishment. Inclusion on a public registry, though, will significantly limit treatment and aftercare options for juvenile sex offenders. Many group homes, foster homes, and community placements will not accept children with sex offenses in their histories. Children on a public registry with community notification requirements will be nearly impossible to place for or after treatment. As a result, many juvenile sex offenders will be kept in juvenile correctional facilities far beyond the time it takes them to complete treatment. Children will be incarcerated not because they need further treatment or pose a risk to public safety, but only because public policy will prevent them from going anywhere else. This is a dramatic, and ill-advised, shift in the focus of the juvenile court system from treatment to punishment.
Subjecting juvenile sex offenders to the same sanctions as adults raises legal and scientific questions about culpability and punishment, and the registration and notification requirements are inconsistent with the purposes of juvenile court: treatment and rehabilitation. Inclusion on an internet-based public registry will subject juveniles to social ostracism, limit access to educational and work opportunities, make it more difficult for juveniles to be placed with family or friends, and limit residential treatment options. And treating juvenile sex offenders in the same manner as adult sex offenders with respect to reporting, notification, and length of classification, even though juveniles have fewer legal rights and protections than adults, presents legal and Constitutional problems.
The plain language of the Adam Walsh Act requires that all children age 14 and older who are adjudicated delinquent for offenses comparable to or more severe than aggravated sexual abuse be included on the public, online registry of sex offenders. But the negative consequences of doing sofewer intra-familial crimes being reported, fewer offenders and victims receiving treatment, and children on the registry being targeted for abuse and exploitation, to name only a fewwould actually put states out of compliance with the stated intent of the Adam Walsh Act: protecting children from violent sex offenders.
